1. Acceptance of these Terms
These Terms of Use (the "Terms") govern your access to and use of the website at coloradohormoneandweightloss.com (the "Site"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
These Terms govern the website only. If you become a patient, your care is governed by the separate intake, informed-consent, and financial documents you sign at that time, and by the terms of Midwest Mind & Body Healthcare. Where those documents conflict with these Terms, those documents control with respect to your care.
Our Accessibility Statement explains how to request an accommodation if any part of this Site is difficult for you to use.
2. Who We Are
This Site is operated by Midwest Mind & Body Healthcare, a Nebraska healthcare practice owned and operated by Kimberly Wohlwend, MSN, APRN, a dual ANCC board-certified nurse practitioner (Family Nurse Practitioner and Psychiatric-Mental Health Nurse Practitioner) licensed in the states where she provides care. Our principal office is 131 N Washington Street, Suite A, Papillion, NE 68046.
Telehealth only in Colorado. We do not operate a physical office in Colorado. Care for Colorado residents is delivered by telehealth.

The content of this Site is provided for general informational and educational purposes only and does not constitute medical advice, diagnosis, or treatment. It is not a substitute for a consultation with a qualified clinician who knows your history.

Descriptions of medications, including GLP-1 medications and hormone therapy, are general. 6. Where We Are Licensed
We provide care only where we are licensed and where state law permits us to practice by telehealth. This Site describes services available to residents of Colorado. You must be physically located in a state where the clinician is licensed at the time of your visit.
Availability can change, and some medications are restricted by state or federal law and cannot be prescribed in every state we otherwise serve. If we determine we cannot treat you within the scope of our license or scope of practice, we will tell you and, where possible, help you find an appropriate alternative.
You must be at least 18 years old to use this Site and to receive care from us.
7. Booking & What Happens Next
The "Book Appointment" links on this Site take you to Tebra, our third-party scheduling platform. Once you leave this Site, Tebra's own terms and privacy policy apply to what you do there.
Booking an appointment does not guarantee that any particular treatment or prescription will be provided. Every prescribing decision is a clinical judgment made after an individualized evaluation. We will not prescribe anything we do not believe is clinically appropriate for you.
Fees, insurance participation, and payment terms are disclosed during scheduling and intake, not on this Site. If you are uninsured or not using insurance, you are entitled to a good-faith estimate of expected charges under the federal No Surprises Act.
8. No Financial Relationship with Third Parties
We have no ownership interest in, and we receive no payment, commission, rebate, referral fee, or other remuneration from, any pharmacy, drug manufacturer, laboratory, or distributor in connection with this Site. This Site carries no advertising and no sponsored content. This is consistent with the federal Anti-Kickback Statute (42 U.S.C. § 1320a-7b), the federal Stark Law (42 U.S.C. § 1395nn), and applicable state self-referral and fee-splitting laws.

This Site links to third-party websites, including our scheduling platform, the website of Midwest Mind & Body Healthcare, and general medical resources. We do not control those sites and are not responsible for their content, privacy practices, accessibility, or availability. Linking is not an endorsement. 10. Website Content & Intellectual Property
All content on the Site, including text, graphics, logos, photographs, and the overall design, is owned by or licensed to Midwest Mind & Body Healthcare and protected by U.S. and international copyright and trademark law. You may view and print content for your personal, non-commercial use. You may not reproduce, distribute, modify, publicly display, or create derivative works without our prior written consent.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Medical knowledge changes. We make reasonable efforts to keep content current, but we do not warrant that everything on the Site reflects the most recent clinical evidence at the moment you read it.
12. Limitation of Liability
NOTHING IN THESE TERMS LIMITS OR EXCLUDES OUR LIABILITY FOR PROFESSIONAL NEGLIGENCE IN THE DELIVERY OF CLINICAL CARE, NOR DOES IT LIMIT ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
SUBJECT TO THE PRECEDING SENTENCE, TO THE FULLEST EXTENT PERMITTED BY LAW, (A) NEITHER WE NOR OUR OWNERS, EMPLOYEES, CONTRACTORS, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE; AND (B) OUR TOTAL CUMULATIVE LIABILITY ARISING FROM YOUR USE OF THE SITE (AS OPPOSED TO CLINICAL CARE) WILL NOT EXCEED FIVE HUNDRED U.S. DOLLARS ($500.00). Some jurisdictions do not allow these exclusions; in those jurisdictions, our liability is limited to the smallest amount permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless the practice and its owners, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from (a) your misuse of the Site, (b) your breach of these Terms, or (c) your violation of law or of the rights of any third party. This does not apply to claims arising from our clinical care of you, which are governed by applicable medical-malpractice and professional-liability law.
14. Governing Law & Disputes
These Terms and any dispute arising out of your use of the Site are governed by the laws of the State of Nebraska, without regard to its conflict-of-law principles. Clinical claims are separately governed by the medical-liability and licensing law of the state where the care was delivered.
For disputes about the Site or these Terms (as opposed to clinical care), you and we agree first to attempt in good faith to resolve the dispute by direct discussion for thirty (30) days. If it is not resolved, either party may file suit in a state or federal court located in Sarpy County, Nebraska, and both parties consent to personal jurisdiction there.
Nothing in this section limits any right you have to file a complaint with a state medical or nursing board, a state attorney general, the U.S. Department of Health and Human Services Office for Civil Rights, or any other government regulator.
15. General Provisions
- Entire agreement. These Terms and the Privacy Policy form the entire agreement between you and us regarding the Site.
- Severability. If any provision is held invalid or unenforceable, the rest remains in full force.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, sale, or other corporate transaction.
- No third-party beneficiaries. These Terms do not create rights in any third party.
- Force majeure. We are not liable for delays or interruptions caused by circumstances beyond our reasonable control, including technology outages, vendor failures, natural disasters, severe weather, power or telecommunications failures, and public-health emergencies.

We may update these Terms from time to time. The "Last Updated" date at the top shows when the current version took effect. If you continue to use the Site after a change, you agree to the updated Terms.
